The constitution envisions a welfare state committed to safeguarding the fundamental rights of its citizens. Although the right to housing is not explicitly articulated, the state is obliged to ensure a dignified life, which inherently includes access to adequate shelter. In this context, the recent anti-encroachment operation and demolitions in the Bari Imam area of Islamabad have raised serious humanitarian and legal concerns. A state that aspires to be welfare oriented must prioritise humane, inclusive and well-planned solutions, particularly for its most vulnerable populations. It is imperative that such actions are guided by constitutional principles, ensuring that no citizen is rendered homeless in the process of urban regulation.
