FCC moved for reinstatement of Ali Amin Gandapur as KP CM

ISLAMABAD: A constitutional petition was filed in the Federal Constitutional Court (FCC) on Thursday, seeking the reinstatement of former Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur to his position.

The petition was filed by Sher Afzal Marwat, a National Assembly member of the Pakistan Tehreek-e-Insaf (PTI)

According to the petition, Ali Amin Gandapur was forced to resign under pressure, and therefore his resignation has no legal or constitutional validity. The petitioner further argued that the former chief minister’s resignation was obtained on the instructions of a convicted and disqualified individual, making the act entirely illegal.

The petitioner requested the court to declare Ali Amin Gandapur’s resignation unconstitutional, unlawful, and void.

The petition also challenged the appointment of the current Chief Minister, Sohail Afridi, arguing that the notification appointing him as Chief Minister of Khyber Pakhtunkhwa is illegal and should be immediately set aside.

It further requested that Ali Amin Gandapur be restored to his office.

Additionally, the petition asked the court to declare all official decisions and actions taken by the government following this allegedly unconstitutional change of chief minister as null and void.
