PESHAWAR: The Peshawar High Court (PHC) has ordered the release of the father of a sick Afghan child on humanitarian grounds.
A single bench of the PHC, headed by Chief Justice SM Attique Shah accepted the petition of the accused, Ibrahim Khan, and directed his release on bail against two sureties of Rs 200,000 each.
Ibrahim Khan was arrested last month under Section 14 of the Foreigners Act for illegal stay and was booked at Peshawar’s Khazana police station.The petitioner’s lawyer, Ibadur Rehman, told the court that the accused’s 14-year-old son, Usman, is suffering from a critical illness, diagnosed as cancer, requiring constant medical supervision and specialized treatment. He added that Ibrahim Khan is the sole breadwinner of the family and is responsible for his son’s care.
The court remarked that, at first glance, the child’s condition appears serious, and keeping the father in custody could adversely affect the child’s health and care. Therefore, without commenting on the merits of the case, the court granted bail to the accused solely on humanitarian grounds.
