SHC takes exception to defective investigations in criminal cases

The Sindh High Court on Thursday took exception to defective investigation by the police and observed that the standard of investigations in criminal cases in Karachi is unsatisfactory.

Hearing the bail application of a man in a dacoity case, an SHC single bench headed by Justice Shamsuddin Abbasi observed that the investigation officer in the case was compromised and asked the additional IG Karachi to look into the matter.

The court stated that the complainant of the case lost their valuable articles of 20 tolas of gold, Rs6 million cash and prize bonds of Rs500,000 and other valuables, but the investigation officer recovered only five grams of earrings from the accused.

It further said that the SP investigation was directed to supervise the investigation and recover the robbed articles and arrest the absconders but he chose to remain absent on the previous date of hearing without any progress.

The additional IG Karachi submitted that there were flaws in the investigation since the investigation and operation had been separated, and that the investigation department had been affected.

He said that the police and the government are taking steps to improve the investigations and the investigation officers are being given incentives for good investigations. He said that the training of the investigation officers is being done so that the quality of investigation could be improved.

The acting prosecutor general submitted that the absconding co-accused was also booked in a murder case in Khairpur. He said that the relevant magistrate did not grant remand of the accused and that is why the looted articles could not be recovered. He said that in any case, delay in recovery affects the investigation of the case.

The high court directed the prosecutor general to submit the progress report on the next date of the hearing.
