ISLAMABAD: The Advocate General Islamabad on Tuesday objected to the maintainability of a petition filed with the Islamabad High Court (IHC), seeking the transfer of PTI founder chairman Imran Khan to a private hospital for treatment.
The court directed the advocate general to get Barrister Aitzaz Ahsan’s power of attorney signed by the PTI founder through the Adiala Jail superintendent.
The court also instructed Imran’s counsel Sardar Latif Khosa to come up prepared on the next hearing with regard to the jail rules.
A Division Bench of the court, comprising Justice Arbab Muhammad Tahir and Justice Khadim Hussain Soomro, heard the plea.
At the outset of the hearing, the advocate general said in the wake of the Supreme Court decision, a medical board, comprising PIMS Dr. Arif and Dr. Nadeem Qureshi, had been constituted for eye treatment of the PTI founder.
He told the bench that the Supreme Court had not given any instructions on the friend of the court’s proposals.
He read out the top court’s order and said that the high court couldn’t issue directives in the petition.
He said the PTI founder’s sentence in the Toshakhana case had already been suspended and he was granted bail.
Justice Soomro remarked that a judgment was also passed after that decision to which the advocate general was referring. The AG said the jail superintendent’s report had arrived.
Sardar Latif Khosa read out the report of Adiala Jail which said the PTI founder was undergoing regular check-ups through the medical board.
The report said the founder of PTI was also treated for his eye by PIMS doctors and he was brought to PIMS twice.
The report said in this case, the founder’s sentence was three years, of which 26 days had been served.
Khosa earlier said Barrister Salman Safdar had submitted a report to the Supreme Court as a friend of court.
“I have attached this report with my application, and I would like to read it,” he said.
He said the friend of the court suggested the treatment of the founder’s eye and also wrote that if the treatment was delayed, it will have serious consequences.
Meanwhile, Barrister Aitzaz Ahsan said he was Imran’s counsel and he had to get the power of attorney signed by Imran Khan.
The court issued directives in this regard.
The Election Commission of Pakistan (ECP)’s lawyer also prayed the court to grant time to hire a new lawyer in this case, which was approved. The further hearing of the case was adjourned till March 12.
