Court dismisses bail plea of man in deadly DHA clash case

A sessions court has dismissed the bail application of a suspect in a case pertaining to a bloody clash between members of the Bugti clan in the Defence Housing Authority, which left five people dead and two others injured.

On July 25, 2024, two rival groups belonging to the Bugti clan engaged in an armed clash in Khayaban-e-Nishat Commercial, Phase VI, DHA, resulting in the death of five people and injuries to several others.

Ali Haider Bugti through his lawyer moved an application before the additional sessions judge (South) seeking post-arrest bail.

After hearing the defence and prosecution sides, the court at the judicial complex inside the central prison dismissed the bail plea. “Keeping in view the gravity of the offence, the number of deceased, the medical evidence, and the overall circumstances, this court is of the view that reasonable grounds exit to believe that the applicant is prima facie connected with the commission of the offence,” he added.

The defence lawyer contended that the applicant was innocent and had been falsely implicated in the present case by the police at the instance of the rival party due to mala fide intention and ulterior motives. He said that the FIR of the incident was lodged after a delay of six hours and no plausible explanation for such delay had been furnished by the complainant.

He said that it was a settled principle of law that where both parties receive injuries and there were counter allegations, the most important question was about the aggressor, which could only be decided during the trial. He claimed that the rival party was the aggressor, as a result of which two young sons of the applicant lost lives, while other family members sustained injuries.

Advocate Abid Zaman and Osama Ali Gujjar, who represented the complainant, opposed the bail application, arguing that the suspect was involved in a heinous and cold-blooded incident of multiple murders, which had shaken the peace of the locality. They said the manner of occurrence reflected a preplanned armed confrontation arising out of previous enmity between the two Bugti groups.

The counsel said the offence was punishable with death or life term, requesting the judge to dismiss the bail plea.
