A sessions court has sentenced a man to six-year imprisonment in a drugs case. Khuda-e-Raheem was found guilty of possessing over one kilogram of ice or crystal methamphetamine in October 2023.
The additional district and sessions judge (West) observed that the prosecution succeeded to prove the charge against him beyond the shadow of doubt. He awarded six years of rigorous imprisonment to the convict for the offence punishable under 9(2)6 of Control of Narcotic Substances (Amendment) Act, 2022 read with Section 6/9-C of Control of Narcotic Substances (Sindh Amendment) Act, 2021.
The court ordered the convict to pay Rs200,000 as fine or undergo additional three months’ imprisonment on default. According to the prosecution, on October 23, 2023, the accused was arrested near a school in Katchi Abadi, Ijtima Gaah Road, Sultanabad. During interrogation, the accused disclosed that he possessed the narcotic substance, ice, or crystal meth, which was lying at his house and he led the police party towards his house situated at Katchi Abadi, Muhallah Sultanabad near TCF School, Ijtima Gaah Road, Manghopir, and took two packets from almirah, which were checked by the police party and the same were found to contain ice weighing 1,065 grams.
In his statement, however, the accused claimed that he was innocent and that he had been framed in the present case. In his written order, the judge observed that the accused refused to testify under oath or provide any witnesses to support his defense during his statement under Section 342 of the Criminal Procedure Code.
“He did not express any ill will towards the police officials who testified against him, and his only explanation was that he was falsely implicated by the police and claimed that the police planted the alleged narcotic on him. However, he did not provide any reason why the police would plant such a large quantity of narcotics upon him.”
The judge said the court found no indication that the police officials responsible for the arrest and recovery were untrustworthy or had any motive to falsely implicate the accused.
