PESHAWAR: The Peshawar High Court (PHC) has restrained the police from harassing a woman and her sons while issuing a written judgment on a petition alleging intimidation by a cop who is the petitioner’s nephew.
In the judgment, Chief Justice SM Attique Shah observed that the petitioner’s nephew, Irfan, is a police employee currently posted on duty with the District and Sessions Judge, Peshawar.The petitioner alleged that Irfan had been continuously harassing her sons and had used the police to conduct repeated raids on her residence.
According to the judgment, the cop claimed that Rs50,000 had been stolen from his house and that a raid was conducted on the petitioner’s home as part of the investigation. However, after examining the record, the court held that no substantial evidence existed of the alleged theft.
The court directed the authorities to refrain from harassing or unlawfully detaining the petitioner’s sons and ordered that no raids be conducted on the petitioner’s residence without lawful justification. The judgment noted that the cop had misused his official position. The court warned that strict departmental action would be taken against the relevant police officials in case of any future violation of its orders or continued harassment of the petitioner and her sons.The court disposed of the petition and advised the petitioner that she may approach the court again through appropriate legal proceedings if she faces further harassment in the future.
