NICVD, health dept get notices over hiring of nursing consultant

The Sindh High Court (SHC) has issued notices to the National Institute of Cardiovascular Diseases (NICVD), the health department and others on a petition against the appointment of a nursing consultant without following the due process of the law.

Humayon said in his petition that the NICVD had issued an advertisement for the post of nursing consultant, and had only written contractual in place of the BPS of the nursing consultant post.

He said that later on the NICVD authorities appointed Abdul Manan as the nursing consultant in BPS-18 without following the due course of the law and the rules.

He added that the respondent has been serving as a nursing consultant at the NICVD but is also drawing a salary from the Sindh Institute of Cardiovascular Diseases (SICVD).

The petitioner said that it is against the settled rules of the services for a person to draw salaries from the government treasury for two institutes at the same time illegally and unlawfully.

He added that as per the NICVD’s Employee Service Regulations 2016-17, Schedule-I (Direct Recruitment Rules), the nursing consultant post does not exist, but the respondent had been appointed as one.

He alleged that the respondent NICVD director had misguided the institute’s governing body to get Manan appointed as the nursing consultant, when the post has neither existed in the budget book nor in the employee service regulations.

He said the appointment of the respondent had been made for two years only but he is still serving at the said posts and benefiting from an exorbitant salary package. He requested the court to direct the respondent to show under what authority of law he claims to hold, occupy and enjoy the office of nursing consultant at the NICVD and the SICVD simultaneously, and to declare his appointment illegal and of no legal effect.
