LHC seeks parties’ response in Hania killing case

RAWALPINDI: Justice Sadaqat Ali Khan of the Rawalpindi bench of the Lahore High Court (LHC) on Thursday admitted a petition filed against the killing of a 9-year-old girl by the CCD in Chakwal and issued notices to the authorities and officers made parties to the petition and sought their response.

Muhammad Nadeem filed the petition through Mian Asif Mahmood Advocate, Maimuna Bint Imdad Advocate, Khaira Malika Zaryab Advocate, Tariq Jamil Mason Advocate and Nazakat Hussain Abbasi Advocate.

Federation of Pakistan, DG FIA, Punjab chief secretary, IG Punjab, RPO Rawalpindi, DPO Chakwal and CCD head Additional IG have been made parties to the petition filed in public interest.

The petition took the position that the CCD officials deliberately targeted the Australian family of Pakistani origin who were victims of robbery on the night of June 10 and 11, and opened indiscriminate fire.

Hania Ahmed, 9, died on the spot while her father Adeel and brother were injured.

When facts were revealed in the media, instead of forming an impartial committee, the police authorities formed a departmental joint investigation team, on which the petitioner made a written request through the prime minister’s principal secretary on June 13 seeking an inquiry into the incident by the FIA.

According to the earlier reports, on June 11, the CCD detained alleged dacoits, named Muhammad Fayyaz and Muhammad Abbas, and extrajudicially killed them.

However, the JIT formed by the DPO Chakwal on the incident clarified in its report that the CCD official opened fire on the family in a hurry without any warning.

The petition states that the CCD extrajudicially killed 1,500 people in custody in one year, which was a violation of Articles 4, 9 and 14 of the Constitution, although Article 9 of the Constitution guarantees life to every citizen.

The petition states that the Lahore High Court has already expressed strong displeasure over the extrajudicial killings of detainees and requests that the DG FIA be directed to investigate the tragedy and submit a report to the court.

After the initial hearing, the court issued notices to the parties and ordered them to submit their responses today (Friday).
