ISLAMABAD: The Islamabad High Court (IHC) issued a notice to the Secretary of the Khyber Pakhtunkhwa (KP) Home Department on a petition seeking the repatriation, of two accused in a murder case, from Saudi Arabia and requested the case record.
The court directed the KP authorities to provide the record regarding the efforts to bring the accused back from Saudi Arabia to the relevant authorities. While hearing a murder case in Swat, IHC Justice Mohsin Akhtar Kayani made important remarks about the failure to produce the accused in last eight years and bring them back from Saudi Arabia. The murder occurred in 2018, after which both accused fled to Saudi Arabia. Both individuals remain fugitives. The court noted that a petition was filed in 2023 to bring the accused back, but that has not happened till now.
Justice Mohsin Akhtar Kayani inquired whether these two men held any special status, asking: “Who are these people? Omar Bacha and Hakim Khan. Are they politicians or members of the royal family?” To which the Assistant Attorney General replied that both accused worked on daily wages. The court remarked, “What should the poor person do whose loved one has been murdered?”
The court added that such circumstances contribute to the increase in crime and lead people to take the law into their own hands. Officials from the Foreign Ministry stated that the KP government had not yet provided the relevant records.
The court ordered that a notice be issued to the secretary of the Khyber Pakhtunkhwa Home Department, directing him to provide the records related to the repatriation of the accused from Saudi Arabia. The court adjourned the further hearing of the case until May 2026.
