ISLAMABAD: The Islamabad High Court (IHC) has adjourned till March 6 the hearing of petitions filed by journalist organizations against the controversial Peca amendment law.
Justice Inam Amin Minhas took up the petitions filed by the PFUJ and the Islamabad High Court Journalists Association (IHCJA) by clubbing them. Samiuddin, counsel for the IHCJA, read out clauses added to the Prevention of Electronic Crimes Act (Peca) after amendment. He said the powers, which should have been held by the judiciary, have been given to the
executive. There should be a judicial tribunal. It should be appointed in consultation with the chief justice. According to the counsel, Section 2 C pertains to ban on fake social media posts. But it is not clear who will determine fake information.
Justice Inam said this should be told how the fake news has to be determined and how the proceedings will be initiated on fake news. The counsel said new procedure for complaint has been introduced in the law under which a third party too can file complaint in addition to the aggrieved party. Due to it, the application can be filed through any proxy and misuse of law is feared. According to the counsel, it is essential to see that fake information is causing what loss because fake information can be merely one mistake which causes no harm to anyone.
Justice Inam remarked this legislation cannot be suspended through stay order. The case will be decided after it is heard. The court then adjourned the hearing till March 6.
