ISLAMABAD: The Islamabad High Court (IHC) will hear intra-court appeals filed by 20 additional apartment sub-lessees of One Constitution Avenue today. A division bench comprising Justice Muhammad Azam Khan and Justice Inam Amin Minhas will hear the case.
Earlier, a single bench of the IHC had dismissed the application of BNP Company challenging the Capital Development Authority’s (CDA) decision to cancel the lease of One Constitution Avenue.
The appellants include former Air Chief Mujahid Anwar Khan and former International Cricket Council (ICC) President Ehsan Mani. They have challenged paragraph 30 of the single bench’s judgment, seeking protection of third-party rights.
In their appeals, the petitioners argued that their legal rights were adversely affected by paragraph 30 of the judgment. They maintained that their rights are recognised through lawful possession of the apartments and that residential Towers B and C were constructed according to the approved layout plan.
The appeals further stated that after the lease cancellation in 2023, the CDA appointed the director estate as administrator and formed a committee with residents to manage the day-to-day affairs of both residential towers. According to the petitioners, they have continued residing in the apartments under the committee operating under the CDA supervision even after the lease cancellation. They argued that they possess lawful rights under the sub-lease agreements and requested the court to declare these rights valid and enforceable.
The appellants also requested the court to restrain the CDA from interfering in their peaceful possession of apartments and to declare paragraph 30 of the single bench judgment null and void.
