ISLAMABAD: Former chairman Senate Mian Raza Rabbani, while raising his strong voice against the proposed transfer of judges of the Islamabad High Court (IHC) to regional benches of the respective high courts, has termed it “undesirable”, saying that transferring a judge without consent impinges on the independence of the Judiciary.
“Such a step will undermine the concept of federalism and equitable representation,” he said in a statement on Monday. Rabbani said the intent of the legislature in the 18th Amendment was to ensure that the IHC, being created in the federal capital, carried representation from the federating units.
“The amendment to Article 200 of Constitution, 1973, of transferring a judge without consent impinges on the independence of the Judiciary,” the former chairman Senate said.
