Kohistan scandal: PHC nullifies asset freeze, orders fresh decision

PESHAWAR: The Peshawar High Court (PHC) on Saturday declared the Accountability Court’s decision to freeze assets in the Upper Kohistan scandal illegal, setting it aside and remanding the case back to the trial court with directions to decide the objections afresh within one month.

A bench comprising Justice Sahibzada Asadullah and Justice Inamullah issued a written judgment on appeals related to the freezing of assets.

The court annulled the accountability court’s October 31, 2025 decision and directed the trial court to reconsider the objections and issue a fresh ruling within 30 days.

During the hearing, counsel for the petitioners, Shaibir Khan, Muhammad Riaz, and Irshadul Hasan argued that the National Accountability Bureau (NAB) had frozen their clients’ assets during the inquiry, and their objections were filed before the accountability court. However, the trial court dismissed all objections while ignoring key evidence. It directed the lower court to hear all parties, record evidence and decide the matter in accordance with the law.
