PESHAWAR: The Peshawar High Court (PHC) has issued a written order staying the recovery of Rs380 million in sales tax by the Federal Board of Revenue (FBR) from the provincial Minerals Department.
A bench comprising Justice Syed Arshad Ali and Justice Qazi Jawad restrained the FBR from collecting the disputed amount until the next hearing.
The court directed all parties to refrain from initiating any coercive recovery proceedings against the petitioner in the meantime.
According to the written order issued after the previous hearing, notices were served on the FBR and other relevant parties, directing them to submit their replies by April 8.
The order stated that a tax demand order was issued against the petitioner on January 1, 2025, which was subsequently challenged before the appellate tribunal.
The petitioner argued that despite repeated reminders, the tribunal has yet to decide the case.
The court’s interim relief effectively halts recovery proceedings until further orders.
