The Sindh High Court (SHC) on Tuesday dismissed a petition seeking the removal of Governor Kamran Khan Tessori for allegedly using his office for political purposes, as the petitioner’s counsel withdrew it.
Petitioners Bux Ali Pirzado and Waheed Ali said the governor’s office is purely a non-political position, but Tessori has engaged himself in political activities during his tenure, causing division and hatred among the province’s residents.
They claimed that the governor’s actions have proved that he is not eligible to hold such a prime position under Article 101(2) of the constitution. They said the Sindh Bar Council (SBC), a regulatory body of the lawyers in the province, also condemned the governor’s recent statement and demanded his removal over his involvement in political activities in violation of the constitution.
The petitioners requested the court to declare that the use of a constitutional office for partisan political purposes in a manner prejudicial to public order and provincial harmony is inconsistent with the spirit and mandate of the constitution.
They also requested the court to declare that Tessori, while holding the constitutional office as the governor, cannot engage in partisan political activities or advocate controversial political agendas from the Governor House.
They requested the court to direct the federation to examine the governor’s constitutional propriety in the light of the SBC resolution’s demand for the governor’s removal. An SHC division bench headed by Justice Mohammad Saleem Jessar asked the petitioners’ counsel about the petition’s maintainability under constitutional jurisdiction. The counsel said he does not want to press the petition, so the court dismissed it as not pressed.
