ISLAMABAD: Following the recent amendments to the National Accountability Bureau (NAB) law, a key legal question has emerged regarding the appropriate forum for hearing the pending bail applications and appeals in the NAB-related cases.
The uncertainty centers on whether these cases should now be taken up by the Federal Constitutional Court (FCC) or remain under the jurisdiction of Supreme Court. In response to this issue, Chief Justice of Pakistan Yahya Afridi has referred all relevant cases to a three-member bench of the Supreme Court. The bench is scheduled to take up the matter for consideration on April 28.
A two-member bench, headed by Chief Justice Yahya Afridi, along with Justice Shakeel Ahmed, on Wednesday heard a post-arrest bail application filed by Aamir Mahmood. The chief justice stated that a three-member bench had ordered that after the amendments, all relevant cases be placed before
it on April 28, 2026, to
determine jurisdiction regarding the hearing of NAB cases.
The key question is whether NAB cases should be transferred to the Federal Constitutional Court or continue to be heard by the Supreme Court.
