ISLAMABAD: The Federal Constitutional Court (FCC) on Monday summoned the record of cases pending before different high courts pertaining to the interpretation and constitutional status of Section 7E of the Income Tax Ordinance 2001
A two-member bench, headed by Chief Justice Ameenuddin Khan, decided to hear the case on a day-to-day basis during the next judicial week. On behalf of the FBR, Advocate Hafiz Ahsan Khokhar and Advocate Asma Hamid appeared and argued that appeals related to this case were pending before the Islamabad High Court.
A total of 319 appeals concerning the interpretation and constitutional validity of Section 7E of the Income Tax Ordinance, 2001 have been fixed for hearing before the Federal Constitutional Court.
These appeals were transferred to the FCC from the Supreme Court of Pakistan in view of the 27th Constitutional Amendment, in which context, among others, Hafiz Ahsaan Ahmad Khokhar, Advocate Supreme Court, is representing the tax department of FBR.
The appeals are from different high courts across the country, raising important constitutional questions about the scope of federal taxation powers, the distinction between income and property taxation, and the legality of “deemed income” under Pakistani law.
