ISLAMABAD: The Federal Constitutional Court (FCC) on Tuesday remanded to Lahore High Court (LHC) the matter pertaining to allotment of property of Evacuee Trust Board (ETPB) to the Punjab Education Department.
A two-member FCC bench comprising Justice Syed Hassan Azhar Rizvi and Justice Muhammad K K Agha heard the appeal filed by the ETPB chairman against the order of Punjab chief minister, allotting the property — owned by the federal government’s subsidiary institution to the Punjab Education Department.
The court set aside the LHC decision that had declared the matter as a government dispute. The FCC remanded the matter to the LHC for fresh hearing, with the direction to decide the case on merit.
During the hearing, Justice Rizvi remarked that allotting ETPB land to the Education Department is not a dispute between two governments, nor is it a conflict between the federal and provincial governments.
The judge questioned the Punjab CM’s decision to allot the land to the Education Department, asking how land designated for Hindu cremations was allocated to the Education Department.
